For disputed contracts, multi-party claims, or situations involving significant sums, a specialist construction lawyer can draft your payment claim, advise on service requirements, and represent you in adjudication.
Each state requires different statutory endorsement language and has different SOPA requirements. Select your state for a pre-configured generator.
A SOPA payment claim must meet several requirements to be valid and enforceable. The exact requirements vary by state, but generally a payment claim must:
1. Be in writing. An oral request for payment is not a valid SOPA payment claim.
2. Identify the construction work. The claim must identify the construction work or related goods and services to which it relates.
3. State the amount claimed. The claimed amount must be clearly stated.
4. Include the statutory endorsement (SOPA states only). NSW, VIC, QLD, SA, ACT and TAS require the payment claim to include a specific statement identifying it as a payment claim made under the relevant legislation. WA and NT do not require this endorsement.
This generator includes the correct endorsement for your state automatically. Always verify the requirements with a construction lawyer before serving.
