What is SOPA?

Australia's Security of Payment (SOPA) legislation gives subcontractors and head contractors a statutory right to progress payments — and to recover money owed through a fast, low-cost adjudication process if payments are disputed or withheld.

The legislation varies by state and territory. NSW uses the SOPA 1999, Victoria uses SOPA 2002, Queensland has its own BIF Act 2017, while Western Australia and the Northern Territory operate under the Construction Contracts Act (CCA) framework — with different deadlines, day-counting rules, and enforcement bodies in each jurisdiction.
