WA CCA — Key Deadlines at a Glance

Western Australia does not use SOPA. Instead, the Construction Contracts Act 2004 (CCA) governs payment disputes. Key differences from SOPA states:

Calendar days: Weekends and public holidays count — unlike the business day counting in NSW, VIC, QLD, SA, ACT and TAS.

Written contracts only: The CCA only applies to written construction contracts. Oral contracts are excluded.

No endorsement required: WA payment claims do not need a statutory endorsement statement.

Payment Response: 14 calendar days for residential contracts. 42 calendar days for commercial and other construction contracts.

Adjudication: Must be applied within 28 calendar days after the payment response due date (or earlier if the response was received early).
