NSW SOPA — Key Deadlines at a Glance

Under the Building and Construction Industry Security of Payment Act 1999 (NSW), once you serve a valid payment claim the following deadlines apply:

Payment Schedule: The respondent must serve a written payment schedule within 10 business days of receiving your payment claim. If they do not, they lose the right to dispute the amount and you can recover it as a debt.

Payment Due Date: 15 business days from the reference date, unless your contract specifies otherwise. Contracts cannot exceed 30 business days from the reference date.

Adjudication Application: If the respondent serves a schedule for less than claimed, you must apply for adjudication within 20 business days of receiving the payment schedule. If no schedule was served, apply within 10 business days of the payment due date.
